Dublin, August 16, 2023 – Survivors of sexual abuse at the Federal Correctional Institution (FCI) Dublin have taken a significant step towards justice by filing a class action lawsuit against the Federal Bureau of Prisons. The survivors assert that inadequate action has been taken to prevent and address rampant staff sexual misconduct within the facility.
Pursuit of Accountability and Reform
Represented by legal counsel, eight survivors of sexual abuse have submitted their lawsuit to the U.S. District Court for the Northern District of California. The plaintiffs highlight that the Federal Bureau of Prisons has long been aware of the pervasive issues and has failed to safeguard those under its care.
The lawsuit emphasizes, "In recent years, staff sexual abuse at FCI Dublin has been so severe that the facility became the center of a sprawling criminal investigation, multiple Congressional inquiries, and national media attention."
A Culture of Silence and Retaliation
A damning report published by The Associated Press last year exposed the alarming culture of sexual misconduct at FCI Dublin. The facility earned the grim moniker "The rape club," reflecting a permissive environment fostering years of abuse, cover-ups, and retaliation against inmates who dared to speak out.
During a news conference announcing the lawsuit, plaintiff Robin Lucas declared, "We're going to change history today... These women will break the glass ceiling."
Calls for Comprehensive Change
The plaintiffs contend that FCI Dublin's crisis cannot be resolved solely through prosecutions. Attorney Amaris Montes of Rights Behind Bars, one of the groups representing the survivors, affirmed, "We need systemic change that ensures survivors are released and receive care and that promotes safety for all those remaining inside."
The lawsuit's demands include:
- Ending retaliation against inmates reporting misconduct.
- Immediate removal of staff with substantiated abuse claims against them.
- Ensuring inmates' access to legal counsel.
- Implementing audits, regular inspections, and continuous monitoring by a third-party organization.
Federal Bureau of Prisons' Response
In response to the lawsuit, the Bureau of Prisons conveyed that it refrains from commenting on pending litigation, ongoing legal proceedings, or investigations.
